Terms & Conditions
Please read the following carefully before you complete your transaction with the Society.
We apologise for the rather formal wording but as you know, sometimes there is no
other way around such matters.
These product terms and conditions affect your rights and liabilities under the law and set out the terms under which The Scotch Malt Whisky Society makes the products available to you ("Product Terms") so please take a moment to read.
Delivery will be made to the address specified by you on the completed order form. Delivery is by courier, Mon-Fri, 9am-5pm. We are able to arrange a Saturday morning delivery for a charge of £10.00. To ensure you receive your order safely, please give a daytime address where someone can sign for delivery. If no-one can sign for your delivery, you can give us a *safe place where we can leave your order - but we strongly recommend that all orders are sent to a delivery address where there will be someone to sign for the parcel (see below). If your parcel is returned, we will have to charge (usually £10.00) to resend.
All orders £100 or over must be signed for and cannot be left in a safe place, please provide full address details. If you request that we leave your parcel in a safe place because there won't be anybody available to sign for, please be aware that this will be done on the understanding that it is at your own risk.
Neither the Society nor its carrier will be liable for non-receipt of the goods. We will deliver to the address as you have entered it on the order. We cannot accept any liability for late or failed delivery if the quoted address is incorrect or incomplete. Please check the delivery address if you are uncertain. If you request a delivery to a business, we shall consider the delivery to be successful, if it is delivered to a reception area and signed for by a representative at that address.
Delivery can take up to 14 days from the date we receive your order, although every effort will be made to despatch earlier. All parcels are sent by insured carrier and must be signed for. Do not accept damaged goods. If goods fail to arrive after 14 days, please notify us on 0131 555 2929 (Mon-Fri 9am-4.45pm).
If you would like your delivery on a certain date (eg. birthday or special occasion), please let us know when you place your order and we will do our best to achieve it.
We do our best to secure delivery within 14 days of the date of your order, but shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.
Please note that we can only deliver whisky to a UK address. Deliveries to non mainland UK addresses will cost an extra £10.00.
Delivery to the Channel Islands
Channel Islands members will be charged VAT at current rate for all transactions, but will receive a discretionary discount from SMWS. Members are responsible for any/all duty charges which may apply for goods dispatched to the Channel Islands*A Safe Place to Leave Your Parcel
The prices payable for the products that you order are clearly set out in the website. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item concerned. All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the items includes the delivery charge.
All the Society's products and services are subject to availability. Your website transaction is a live purchase so if you have managed to get your hands on the bottle you were looking for, its yours!
As all products and services are subject to availability, there will be no contract of any kind between you and us unless and until we actually process and dispatch the goods to you. As stated above (under Availability) your order is an offer to buy from us. This means that nothing that we do or say amounts to any acceptance of that offer until we actually process and dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are processed and dispatched, and not before, a contract will be made between you and us and you will be charged for the goods.
We cannot sell alcoholic products to anyone under 18. For this reason, we may refuse an order at our discretion and orders may not be transferred from the customer to any other person.
We hope you will be happy with your purchase. However, should you feel it necessary to return an item, we aim to make the returns process as simple as possible. To arrange this, please contact us on 0131 555 2929 (Mon-Fri 9am-4.45pm). Please note the Society cannot replace any whisky bottles that have been opened. We must be notified of damaged goods within 2 days of delivery. Beyond this, our insurance is invalid.
If you have bought a ticket for one of our events and are no longer able to attend, please let us know at least 14 days in advance in order to arrange a refund
You can pay by any American Express, Mastercard or Visa credit card, Switch or Delta debit card. We do not currently accept Visa Electron cards. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order.
You will be automatically charged for your order once payment has been completed. If your order is dispatched in more than one delivery, payment for each will be taken from your credit/debit card at the point of dispatch, and our acceptance of each part of the order takes place on dispatch of the product.
Our liability to you in connection with any order will not exceed the total price charged for the relevant items.
